100 – Stop property taxes

A YES on 100 amends the Arizona Constitution to prohibit new fees or taxes on the sale or transfer of homes or other real estate after Dec. 31, 2007.

(No such new fee or tax has been enacted since that date.)

PRO: A YES for Proposition 100 eliminates a case of “double taxation.”  A real estate sales or transfer tax is unfair since home and property owners already pay annual property taxes. An additional tax, levied at the time people buy, sell or even transfer ownership of their home into a legal trust or to a family member, would be double taxation. Also, this initiative will help keep housing affordable in Arizona by preventing a rise in closing costs and will allow more Arizonans to purchase a home or property while protecting those living on a fixed or low income.

 

CON: A NO on Proposition 100 changes the constitution of Arizona to protect real estate corporations and developers. It would also tie the hands of Arizona’s elected officials in dealing with Arizona’s fast growth and ways to finance new needs. The Arizona Education Association opposes this initiative because it believes 100 will have long-term, damaging effects on public schools and universities.

 

101Freedom of Choice in Health Care Act

Amends state Constitution to permit freedom of choice in health care.

A YES on 101 would prohibit laws that restrict an individual’s freedom of choice of private health care plans.

PRO: Medical industry special interests are pushing legislation that would restrict and penalize people changing medical plans. This measure would prohibit laws restricting people’s right to pay for a plan that is right for them.

 

CON: A Constitutional amendment could prevent the state from creating a system assuring everyone access to the care they require. Removing state regulation could allow abuses that private practitioners, hospitals, and patients now suffer from private insurance carriers.
